A loophole in the law allows company-to-company trade (also known as 'trade sales') to be out of the scope of the current regulations. This loophole allows for social media influencers to receive promotional items as business gifts that are not covered by current regulations.
The MHRA (Medicines and Healthcare products Regulatory Agency) is the competent authority for E-cigarettes in the UK and is responsible for implementing the rules and regulations under the TRPR (Tobacco and Related Products Regulations).
The MHRA has explained that UK law permits e-cigarettes to have a maximum e-liquid capacity of 2ml with a maximum nicotine strength of 20mg/ml. However, as some of the Elf Bars present in the Elf Bar advent calendar have an e-liquid capacity of greater than 2ml, they cannot be sold legally in the UK. Therefore, these Elf Bars lack the safety testing that all legal Elf Bars must obtain before UK sale to the general public.
